Investing in culture, and particularly in visual arts, has always had a profound impact—not only in the private sphere but also in the creation and development of priceless collections, often made accessible to the public. Today, while issues of valuation and estate planning are well defined legally, new challenges are emerging: is art an asset like any other? How can one continue to invest in the age of digitalisation, tokenisation, and artificial intelligence? What are the difficulties in valuing a collection, whether domestically or abroad, opening a dedicated venue, or lending artworks?

Biographies

Alejandro Dominguez is a Partner in CMS Luxembourg Tax practice. Alejandro has experience in tax structuring advice for investment funds, securitization transactions and project financing specifically investing in art assets. He also regularly advises UHWNI on international tax matters. He has published several articles in university and international tax publications. Before joining CMS Luxembourg, Alejandro gained several years of experience working both as in-house legal and tax counsel for a French insurance group and as senior associate in the Luxembourg tax team of an international law firm, being seconded to a global investment bank in London. He has also lectured on tax in Universities in Luxembourg and Colombia. 

Frédéric Feyten is a Partner and heads the Luxembourg Tax practice group. Frédéric's focus is on Luxembourg and international taxation, mergers and acquisitions, financial products, structured finance and securitisation. Having advised international corporate clients, investment banks, financial institutions and private equity firms, Frédéric has extensive advisory experience in direct and indirect taxation, international tax planning and structuring cross-border transactions through Luxembourg.

Dimitar Hadjiveltchev joined CMS Francis Lefebvre in 2001 and is an equity partner in 2016. He is co-heading the CMS Private Clients group since 2020. This a practice group gathering +250 lawyers from +20 jurisdictions. He advises high-net-worth individuals and families on complex national and international tax cases, including wealth and income structuring, intergenerational transfer planning, and supports clients in their international projects, whether in the context of their investment projects, particularly in luxury real estate and vineyards, or in their professional projects, as well in the determination of their tax residence. His expertise includes the advisory work for foreign trusts and similar structures, with respect to their tax treatment and their compliance duties. Dimitar Hadjiveltchev also assists his individual clients with theirtax compliance (review, preparation, filing of personal tax returns - income tax, wealth tax and self-disclosure procedures). In his corporate practice, he supports French and international companies and groups in managing the preferred income tax regimes that can be applied to executives and high-potential managers. In the area of compliance, he coordinates and manages issues relating to personal tax returns (income tax, wealth tax, gift and inheritance tax returns) as well as the returns for the administrators of trusts and similar entities. Dimitar Hadjiveltchev also assesses whether clients’ situations or projectsnpresent potential risks in terms of anti-money laundering rules or rules against aggressive tax planning (DAC 6).

Jean-Philippe Thiellay joined CMS Francis Lefebvre in 2025. A State Councilor, he specializes in public law, particularly in the field of cultural industries. With over 15 years of experience at the State Council and more than 10 years in the senior management of public institutions, Jean-Philippe Thiellay has acquired extensive expertise in public action and litigation practice before all French administrative courts, European courts, sectoral regulatory authorities, and judicial courts, especially in matters related to regulation. He advises private companies, both French and international, as well as public enterprises and institutions on complex governance, development, and restructuring issues. He is particularly involved in matters relating to the regulation of sectors such as media, audiovisual, digital, telecommunications, and cultural industries. He also works closely with other teams within the firm on all types of operations involving public law, in whole or in part (liability, land-use and planning policy, urban planning.
